  • You take a chemical test (breath or blood test) and have a blood alcohol concentration of .08%
  • You refuse chemical testing

For failing a chemical test, a first offense, your license may be suspended for 90 days. For a first offense of refusing chemical testing, your license may be suspended for 180 days.
